1. About these Terms

These Terms of Service ("Terms") govern your use of Headshots AI ("we", "our", "us"), accessible at headshots-ai.com. By using our service you agree to these Terms in full. If you do not agree, please do not use the service.

2. The Service

Headshots AI uses artificial intelligence to generate professional headshot images from photographs you upload. We provide a watermarked preview free of charge. Full-resolution, unwatermarked images are a paid digital product delivered immediately upon purchase.

3. Eligibility

You must be at least 18 years old to make a purchase. By purchasing you confirm that you are 18 or over and have the legal capacity to enter into a contract.

4. Your Content

You retain ownership of any photographs you upload. By uploading, you grant us a limited, non-exclusive licence to process your images solely to provide the service. We do not sell, share, or use your photographs to train AI models. Uploaded photos and generated images are automatically deleted after 30 days.

You confirm that you own or have the right to use any photographs you upload, and that they do not infringe any third-party rights.

5. Payments

Payments are processed securely by Stripe. We do not store your card details. All prices are displayed inclusive of any applicable taxes.

6. No Refund Policy

All purchases are final and non-refundable. Because our product is a digitally delivered item that is made available to you immediately upon payment, you acknowledge that you lose your right to cancel or receive a refund once the download has been made available.

Before purchasing you are shown a full watermarked preview of your generated headshot. This preview accurately represents the final full-resolution image you will receive. By proceeding to payment you confirm that you have reviewed your preview and are satisfied with the result.

Exceptions are made only where required by applicable consumer protection law, or in cases of technical failure on our part where the full-resolution image was not delivered. To report a delivery failure contact us at support@headshots-ai.com within 48 hours of purchase.

7. Acceptable Use

You must not use the service to:

Upload images of other people without their explicit consent
Generate images intended to deceive, impersonate, or defraud
Violate any applicable law or regulation
Attempt to circumvent rate limits, security measures, or access controls

We reserve the right to suspend or terminate accounts that violate these terms without notice.

8. Intellectual Property

Upon purchase, you are granted a perpetual, worldwide, royalty-free licence to use your generated headshots for personal and commercial purposes including LinkedIn, CVs, websites, and marketing materials.

You may not resell or redistribute generated images as stock photography or as a competing AI headshot product.

9. Disclaimer of Warranties

The service is provided "as is" without warranties of any kind. AI-generated images are subject to the inherent variability of generative models. We do not guarantee that every generated image will meet your expectations, which is why a preview is provided before purchase.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of the service shall not exceed the amount you paid for the relevant purchase. We are not liable for any indirect, incidental, or consequential losses.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by updating the "Last updated" date above. Continued use of the service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.
